LAST WILL AND TESTAMENT OF THOMAS PHILLIPS RECORDED IN WILL BOOK 1, PAGE 106, RANDOLPH CO., WV
In the name of God, Amen. 1, THOMAS PHILLIPS, SENIOR, of the County of Randolph and State of Virginia, considering the uncertainty of this mortal life and being of sound mind and memory, blessed be God for the same, do make and publish this my Last Will and Testament, in manner and form following, that is to say, I give and bequeath unto my beloved wife her being while she remains my widow of the place, that is to say our milch cow yearly and she is to give her back [-----] when not giving milk. I do allow her Twenty Bushels of Grain a year and yearly that’s to say, Ten of Com and five of wheat and five of Rye and three hundred weight of pork a year and her bed and beding and as long as she lives on the place she is to have the above support and I also give and bequeath unto my youngest son, MOSES PHILLIPS, my [------] that I now possess and I also give and bequeath unto son BENJAMIN PHILLIPS my lots in the Town of Beverly and County and State aforesaid and I give and bequeath unto Henry, Isaac, Joseph, John, Thomas, William, Benjamin One Dollar each as I do allow they have got their full shear before and as for personal property I do allow and bequeath to Moses at my death all my goods and chattles of every kind and I do revoke all former Wills and Testaments but this present. IN WITNESS Thereof, I hereunto set my hand dated the twelfth day of January One Thousand Eight Hundred and Six.

Mark Signed, Sealed and declared by the above named Thomas Phillips to be his Last Will and Testament in the presence of us who have hereunto subscribed our names to Witness in the presents of the Testator. Richard Kittle Abraham Kittle, Junr. John Sproul

It is hereby acertained by the within Testator that John Stalnaker is to have the benefit of his lease for five years,

1, SUSANNAH PHILLIPS, wife of Thomas Phillips, Senr., late deceased the eighth day of August, One Thousand Eight Hundred and Ten doth assign my name to the within Will of my husband, it being his Last Will and Testament and I also do agree and is fully satisfied with the within Will.

In Witness Whereof, I hereunto set my hand and seal dated this 14th of August 18 1 0. Susannah Phillips (her mark) Signed Sealed in the present of us, Isaac Kittle, John Sproul.

RANDOLPH COUNTY, August Term, 1810: This, the Last Will and Testament of Thomas Phillips, Sr., with the assent of Susanna Phillips endorsed thereon, was produced in Open Court, proven by the oaths of Richard Kittle, Abraham Kittle and John Sproul subscribing witnesses and ordered to be recorded.
